Terms and Conditions for Batin Studio
Effective Date: December 8, 2024
Welcome to Batin Studio! These Terms and Conditions ("Terms") govern your use of our services and define the agreement between you ("Client") and Batin Studio ("we," "us," or "our"). By engaging with our services, you agree to these Terms.
1. Services Provided
Batin Studio offers a range of services, including but not limited to:
Subscription-based design and development services
One-time project-based services
Custom SaaS, PWA, and Shopify solutions
Product design and development solutions
The scope of work, deliverables, and timelines will be defined in a signed proposal or agreement prior to project commencement.
2. Subscription Plans
Subscriptions are billed monthly in advance. Payment must be made by the due date to ensure uninterrupted service.
Each subscription plan offers a limited scope of hours or deliverables as outlined in the chosen package.
Any additional work outside the scope of the subscription will be billed separately upon agreement.
Clients may cancel subscriptions with a 30-day written notice. Refunds for partial months are not provided.
3. Payment Terms
All invoices must be paid within 7 days unless otherwise agreed upon in writing.
Payments are accepted in euros (€) unless stated otherwise.
Late payments may incur a late fee of 5% of the total invoice amount per month.
For project-based services, 25% of the total project cost is required upfront to begin work.
4. Intellectual Property
Upon full payment, the intellectual property rights of deliverables are transferred to the Client.
Batin Studio retains the right to showcase non-confidential work in its portfolio unless expressly prohibited by the Client.
All pre-existing tools, templates, or code libraries used in deliverables remain the property of Batin Studio.
5. Confidentiality
Both parties agree to keep confidential information private and not disclose it to third parties without written consent.
Batin Studio may sign a Non-Disclosure Agreement (NDA) if required.
6. Limited Availability
Subscription services are limited to ensure quality. Availability is on a first-come, first-served basis.
Clients will be notified if spots are unavailable and may be placed on a waiting list.
7. Revisions and Feedback
Clients are entitled to revisions as per the scope defined in the agreement.
Delays in providing feedback may impact timelines and deliverables.
Significant changes outside the original scope may incur additional charges.
8. Refund Policy
If the Client is not satisfied with our services, they may request a refund within 7 days of payment. Batin Studio will refund 80% of the payment.
Refunds will not be provided for a change of mind.
9. White-Label Services
Batin Studio provides fully white-label services and will not take any credit for the work delivered.
All deliverables will be branded under the Client's identity unless otherwise agreed.
10. Termination
Either party may terminate the agreement with written notice if the other party breaches these Terms.
In the event of termination, Batin Studio will deliver all completed work up to the termination date, provided payments are up to date.
No refunds will be provided for work already completed or in progress.
11. Limitation of Liability
Batin Studio is not liable for indirect, incidental, or consequential damages arising from the use of its services.
Total liability for any claim shall not exceed the amount paid by the Client for the specific service.
12. Governing Law
These Terms are governed by the laws of [Your Country], and any disputes shall be resolved in the courts of Bangladesh.
13. Amendments
Batin Studio reserves the right to update these Terms at any time. Clients will be notified of significant changes.
By engaging with Batin Studio, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
